Terms of Use

1. Scope

These terms govern your use of the BandKit web application and related services (collectively, the “Service”). BandKit is a band management platform that helps musicians organise shows, setlists, riders, finances, and band membership.

By creating an account or using the Service, you agree to these terms. If you do not agree, please do not use BandKit.

2. Description of the Service

BandKit provides the following features:

  • Band member management with role-based access (owner, admin, member)
  • Show management (venues, dates, timetables, contacts, links)
  • Setlist creation and song repertoire
  • Rider file uploads and sharing
  • Band finances with transaction tracking and settle-up
  • iCal calendar feed for subscribing to show schedules
  • Bandsintown CSV export
  • Email invitations and shareable invite links

The available features depend on the subscription tier (Free or Pro). We may add, modify, or discontinue features at any time.

3. Account registration

You must create an account to use BandKit. You agree to provide accurate and complete information during registration and to keep your details up to date.

You are responsible for keeping your login credentials confidential. Any activity that occurs under your account is your responsibility. If you suspect unauthorised access, contact us immediately.

4. Free and paid plans

BandKit offers a free tier with limited resources and a paid Pro tier with expanded limits and additional features. Current pricing is displayed on the subscription page within the app.

Pro subscriptions are billed monthly or annually in advance. Prices are in Swiss Francs (CHF). You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

We reserve the right to adjust pricing. Price changes will be communicated in advance and apply from the next billing cycle.

5. Acceptable use

You agree to use BandKit only for lawful purposes. In particular, you must not:

  • Upload content that infringes copyrights or other third-party rights
  • Upload malicious files or attempt to compromise the Service
  • Use automated tools to scrape or extract data from the Service
  • Interfere with other users' use of the Service
  • Misuse band invitations or shared links for spam or harassment

Violations may result in temporary or permanent suspension of your account at our discretion.

6. Your content

You retain ownership of all content you upload or create in BandKit (including shows, setlists, songs, rider files, and financial data). We do not claim any intellectual property rights over your content.

By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of operating BandKit. This licence ends when you delete your content or your account.

You are solely responsible for the content you upload. Make sure you have the necessary rights to any material you add to BandKit.

7. Privacy and data protection

We take the protection of your personal data seriously. Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

8. Availability

We strive to keep BandKit available at all times but cannot guarantee uninterrupted access. Scheduled maintenance will be announced where possible. We are not liable for downtime or data delays caused by circumstances beyond our reasonable control.

9. Limitation of liability

BandKit is provided on an “as is” and “as available” basis. To the maximum extent permitted by Swiss law, we disclaim all warranties, whether express or implied.

We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. In particular, we are not responsible for loss of data. We recommend keeping your own backups of important information.

This limitation does not apply to damages resulting from intent or gross negligence, or to liability that cannot be excluded under Swiss law.

10. Termination

You may delete your account at any time from your profile settings. Upon deletion, your personal data and content will be permanently removed within 30 days.

We may suspend or terminate your account if you materially breach these terms. In such cases, we will notify you and provide a reasonable explanation unless prohibited by law.

11. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of BandKit after such notice constitutes acceptance of the revised terms.

12. Governing law and jurisdiction

These terms are governed by Swiss law. The exclusive place of jurisdiction for any disputes is Zurich, Switzerland.
